General Terms and Conditions (GTC)

Note: This is a translation of the original German GTC. In case of discrepancies, the German version shall prevail.
1. Scope
These General Terms and Conditions apply to all business relationships between PA Kfz-Überstellung (hereinafter "PA") and its customers (hereinafter "Client").
2. Subject of Contract
The subject of the contract is the transfer of motor vehicles on their own wheels. PA undertakes to transport the vehicle carefully and professionally to the destination.
Payments
Invoices are to be paid promptly in cash or by instant bank transfer upon performance of the service, unless otherwise agreed.
A deposit of 50% of the agreed sum is to be paid upon placing the order, unless otherwise agreed.
In the event of default in payment, default interest at the customary bank rate will be charged.
3. Obligations of the Client
The Client assures that the vehicle to be transferred is roadworthy (unless otherwise agreed) and contains no dangerous goods.
The Client is obliged to inform PA in writing in advance of the exact dimensions, weights, and special characteristics of the vehicle to be transferred.
Fee Claim & Cancellation Policy
The fee claim of PA remains valid if the fulfillment of the order becomes impossible without the fault of PA and/or is omitted for reasons attributable to the Client.
If the Client cancels the order already placed, the following cancellation conditions apply: Cancellations up to 14 days before the agreed date are generally free of charge (costs already incurred must be reimbursed). Up to 7 days before the date, 25% of the fee applies, thereafter (less than 7 days before the date) 50% of the fee (plus costs already incurred). In the event of cancellation on the day of collection, the full agreed sum (100%) is to be paid. In all cases, additional costs already incurred as well as any additional costs arising from the cancellation must be borne by the Client.

The cost calculations presented on the website using the price calculator are non-binding estimates based on automated distance calculations. They do not constitute a legally binding offer.
A binding contract is only concluded when PA submits a concrete offer after the request form has been sent by the Client and this is accepted by the Client.
Accompanying Documents
The Client is obliged to hand over to PA all accompanying documents required for the transport (e.g., vehicle registration certificate). The Client is liable for the correctness and completeness of these documents.
Liability
PA is only liable for damages resulting from the agreed transport on own wheels in cases of intent or gross negligence.
Defects must be claimed in writing immediately upon acceptance, otherwise they are excluded.
For stone chip damage, especially to windshields, PA is only liable in cases of intent or gross negligence.
Condition upon Handover
Vehicles must be made available by the Client in a condition that is not soiled, icy, or covered with snow, otherwise an inspection for damage is not possible. PA is not obliged to clean the vehicle.
Jurisdiction and Law
For all disputes arising from this contract, the court locally competent for Vomp is exclusively agreed.
Austrian law applies exclusively.
Right of Withdrawal for Consumers
Consumers have the right to withdraw from this contract within 14 days without giving any reason.
If the consumer has requested that the service should begin during the withdrawal period, he shall pay an amount which corresponds to the proportion of the services already provided up to the time at which he informs PA of the exercise of the right of withdrawal in comparison to the total scope of the services provided for in the contract. The right of withdrawal expires completely if the service has been fully provided at the express request of the consumer.
